Success in confiscation proceedings

James O’Hara acted in confiscation proceedings in which the prosecution contended the defendant had 100% of the equity in a property available to him to satisfy a confiscation order. The defendant was the sole legal owner of the property.


Following the service of evidence by both the defendant and the third party, the prosecution conceded the defendant’s beneficial interest in the property was limited to 50%.
