Success in confiscation proceedings

Updated: Jul 26, 2023

James O’Hara acted in confiscation proceedings in which the prosecution contended the defendant had 100% of the equity in a property available to him to satisfy a confiscation order. The defendant was the sole legal owner of the property.

Following the service of evidence by both the defendant and the third party, the prosecution conceded the defendant’s beneficial interest in the property was limited to 50%.

James instructed Abigail Bache of Garden Court Chambers.

James represents clients involved in all litigation arising from the Proceeds of Crime Act 2002 and The Criminal Finances Act 2017. To discuss your case with James, please call 0773 9327 158 or email .
