Success in Civil Claim Arising from the Terrorism Act

Daniel Lemberger Cooper, Partner, and Patrick Dunne, solicitor, acted for X in connection with an action for damages arising from their arrest and detention under paragraph 18 of Schedule 7 to the Terrorism Act 2000, and a subsequent search under warrant.
The Claimant alleged that each period of arrest and detention was unlawful, including that the Defendants’ actions constituted discrimination on the basis of their political beliefs and/or unjustified interference with their travel for a partially journalistic purpose.
The Claimant’s claim was for false imprisonment, trespass to the person, trespass to property and breaches of Articles 5 and 10 of the European Convention on Human Rights.
There was a Case and Cost Management hearing in this matter and directions to Trial were made.
There was significant legal and procedural complexity in the action and the Claimant received substantial damages in the resolution of their claim.
