Account Freezing Order Success

Our James O’Hara was successful in satisfying an applicant who obtained an Account Freezing Order, that the funds in the account did not represent recoverable property (as defined by PoCA 2002).


In early 2022, a Ukrainian national fleeing war made a large deposit into their recently opened bank account. The funds represented money taken from Ukraine. The funds were subsequently frozen on an ex parte application by the Police.


Following the service of evidence and detailed submissions, the applicant confirmed the funds should no longer remain frozen.
