Imran Khan & Partners acted for Mr C and his family, who sought to ensure that the local authority responsible for his care would facilitate a cross-border move from England to Scotland to be closer to his family.
Imran Khan & Partners argued that the local authority’s decision to refuse to facilitate a care placement for Mr C to be closer to his family was unlawful, as the provision of accommodation and the care package were being viewed as mutually exclusive. We also argued that the local authority was failing to consider Mr C’s best interests and that, in refusing to allow him to be closer to his family support network, this amounted to a breach of his human rights under Article 8 ECHR.
As a result of the action, Mr C and his family now have reassurances that a move is on the horizon and will work with the local authority to identify a suitable care placement to ensure that he can be moved closer to his family support network.
