Imran Khan & Partners Instructed in Significant Legal Challenge Against NHS England Over IHRA Definition

Imran Khan & Partners have been instructed to represent Claimants, including the Right to Protest Limited, in a judicial review challenging NHS England’s adoption of the IHRA (International Holocaust Remembrance Alliance) definition of antisemitism. It is argued that the definition was adopted on 16 October 2025 without consultation, transparency, or safeguards, and its use has already restricted lawful expression and created concern among healthcare professionals, patients, and academics.
The legal action follows a Letter Before Claim sent on 23 December 2025. It seeks to protect fundamental rights, including freedom of expression, professional integrity, and the ability to raise ethical concerns without fear of reprisal.
Concerns have been raised about the definition’s application, which blurs the line between legitimate political or ethical speech and racism. Professionals raising concerns are increasingly treated as potential offenders rather than individuals acting in good faith, placing careers, reputations, and wellbeing at risk.
It is asserted that no risk assessment was carried out prior to adoption, leaving unclear how restrictions will be enforced or how patients may be affected. This uncertainty has created widespread concern across the NHS.
The judicial review challenges the growing reliance on the IHRA definition by regulators and public bodies to restrict lawful speech. The action seeks to ensure the NHS remains guided by ethics, evidence, and humanity rather than political pressure or intimidation.
