Imran Khan and Partners has secured an acquittal in an importation of firearms case at Snaresbrook Crown Court.
In April 2022, UK Border Agency intercepted a package being imported from the USA, which contained a large quantity of controlled firearms components. The Police held the Defendant responsible for ordering the components and the Defendant was charged with Purchasing or Acquiring Illegal Firearms Without a Certificate.
The Defence argued the charge and on the first day of trial, the Prosecution indicated they would offer no evidence on Count 1 - Purchasing or Acquiring a Firearm Without a Certificate but instead would proceed to trial on amended indictment, with Count 2 - Being Knowingly Concerned in the Fraudulent Evason of a Prohibition on the Importation of Goods.
Subsequently, the Defence submitted an application to dismiss Count 2 on the basis that the Defendant’s mobile was downloaded and examined and there was no evidence connecting him to the delivery of the package and that the Crown’s case mostly relied on the assumption.
The Judge granted the Defendant’s application and dismissed Count 2 and returned a Not Guilty verdict in respect of Count 1.
